The consortium in charge of restructuring the world’s most infamous private-security firm just added a new chief in charge of keeping the company on the straight and narrow. Yes, John Ashcroft, the former U.S. attorney general, is now an “independent director” of Xe Services, formerly known as Blackwater.I don't know which is more revolting, Ashcroft as ethics chief, or the fact that these incompetent corrupt f%$#s still get government contracts.
Ashcroft will head Xe’s new “subcommittee on governance,” its backers announced early Wednesday in a statement. The subcommittee is designed to “maximize governance, compliance and accountability” and “promote the highest degrees of ethics and professionalism within the private-security industry.”
In other words, no more shooting civilians in Iraq and Afghanistan, no more signing for weapons its guards aren’t authorized to carry in war zones, no more impersonations of cartoon characters to acquire said weaponry, and no more ‘roids and coke on the job.
Ashcroft’s arrival at Xe is yet another clear signal it’s not giving up the quest for lucrative government security contracts now that it’s no longer owned by founder Erik Prince, even as it emphasizes the side of its business that trains law enforcement officers. In September, it won part of a $10 billion State Department contract to protect diplomats, starting with the U.S. consulate in Jerusalem.

In California, Republicans are refusing to even allow tax increases to be voted on, so Treasurer Bill Lockyer and Senate President Pro Tem Darrell Steinberg are suggesting that cuts be targeted in Republican districts:
Good for him.
One of the reasons that there are so many no taxes ever lunatics out there is because they manage to structure taxation, and benefits, such that other people pay for their services, and this needs to stop.
With no agreement in sight on how to close the state's remaining $15.4 billion deficit, some Democrats are discussing targeting GOP districts with steeper cuts if legislative Republicans will not vote for a solution that includes taxes. What he is referring to here as "convenience services" is (I hope) things like DMV offices, vehicle inspection stations, agricultural extension offices, etc.
"You don't want to pay for government, well then, you get less of it," Senate President Pro Tem Darrell Steinberg told reporters Wednesday.
If other options fail, the Sacramento Democrat said he is willing to consider a targeted cuts approach like one laid out by Treasurer Bill Lockyer, who has suggested that an all-cuts state budget should focus on the districts of lawmakers who oppose putting $11 billion in tax extensions before voters.
"When it comes to kids or the vulnerable, I wouldn't want to make distinctions between who lives in a Democratic district and who lives in a Republican district, but when it comes to sort of basic services, convenience services that affect adults ... I have an open mind," he told reporters after speaking at a Sacramento Press Club luncheon.
Good for him.

It Looks Like 6 of 8 'Phant Senators Are Up for Recall in Wisconsin
When one considers that there have been just 4 recall elections in Wisconsin history, this is pretty impressive, there are additionally 3 recall elections against Democratic state senators, but, as anyone who follows Maddow knows, the effort was significantly less grass roots and honest. (Signatures for shots of booze)
Additionally, there was a special election in a solidly Republican district for the State Assembly, and it flipped to the Democrats for the first time in a rather long time.
The Dems have to win 3 seats to flip the Senate, which is a non-trivial task, but I think that the voters of Wisconsin are feeling a sh%$load of buyers remorse right now.

They Had an Election in the Great White North
The Conservatives now have an outright majority in Parliament, posting a 24 seat gain to end up with 167 seats, which was not a big surprise, but the rest of the results were a shocker.
The left leaning New Democratic Party (NDP) picked up 66 seats, and now has 102, making it the official opposition for the first time ……… ever, while the Liberals, who have run Canada for most of the past 100 years, lost 43 seats, dropping to 34, and their party leader, the contemptible Iraq war cheerleader Michael Ignatieff, lost his seat.
Even more surprising is that the secessionist Bloc Québécois also lost 43 seats, dropping to just 4 seat, which means that they lost official party status, and their party leader lost his reelection bid too.
Hopefully, this means that the BQ will have to take their time away from genteel ethnic cleansing* to rebuild their party.
Both Lib Leader Michael Ignatieff and BQ Leader Gilles Duceppe resigned their party positions as well.
The Tories did not get anywhere near a majority of the vote, they got less than 40%, but they got them in the right places, and with the NDP surging, largely because the Liberals had been folding like a bunch of broccoli ever since Ignatieff took control, and people choose something, particularly a something which gave them their world class healthcare system, over nothing, they went to the NDP.
The downside is that Conservative leader Stephen Harper, after 2 terms running a minority government, probably feels entitled to do what he really wants, which is tax cuts for the wealthy, cuts in social services, and more prisons and fighter jets.
I fully expect a stealth assault on socialized medicine.
On the bright side (if you are an optimist):
- The BQ and their nativist bigoted platform were beaten down.
- The Libs deserved to go down, and the only thing keeping them afloat over the past few years was "the conservatives are scary," don't split the vote, but now the NDP can make this argument.
- Harper is a real honest to God Neocon, and the only thing that has made him look moderate is the fact that he has had minority governments, so hopefully, when the mask is removed, Canadians will recoil from him, and make Mulroney's drubbing look like a walk in the park.
- Perhaps the Liberals will learn that folding like overcooked cabbage because an insane right winger said bad things about them.
- Perhaps the Liberals will learn that appointing an Iraq War supporting moron (Michael Ignatieff) is stupid.
- Michael Ignatieff is done.
- Michael Ignatieff is done.
- Michael Ignatieff is done.

Yet Another Dissection of the bin Laden Killing
First, it comes out now that bin Laden was not armed and did not use his wife as a human shield, which implies to me that perhaps the reason for his burial at sea was to obscure the powder burns caused when a muzzle of a weapon is pressed against the head.
Second is the question of, "Why Now?," and I think that this analysis is the one closest accurate: that the House of Saud determined that with unrest through the Arab world, he had become redundant:
Second is the question of, "Why Now?," and I think that this analysis is the one closest accurate: that the House of Saud determined that with unrest through the Arab world, he had become redundant:
Normally I do not speculate on operational matters; to solicit information on secret matters even from very good sources is like telling Pinocchio, "Lie to me." Some considerations here are obvious, though, even without the usual disinformation. It is hard to conclude otherwise that Bin Laden died this week because people who knew his whereabouts chose this particular moment to inform the US authorities. What has changed? The simple answer is: everything has changed. Instability in the Muslim world has reached a level that makes Bin Laden redundant.I think that he's wrong about one thing: al Qaeda wasn't done in by some sort of Iranian alliance, these folks are Salafists, and consider Shia to be heretics, but rather they are terrified at the idea that Jihadism is fading as an outlet for desires for reform and democracy in the dominion of the House of Saud, and they are casting about for some other way to maintain their kleptocracy.
The overthrow of Egyptian president Hosni Mubarak and the near-overthrow of Yemini President Ali Abdullah Saleh, along with the eruption of instability across the whole of the Arab world, changed al-Qaeda's position. From Riyadh's vantage point, Bin Laden was a loose cannon and an annoyance, but no threat to the strategic position of Saudi Arabia.
The royal family preferred to allow some of its more radically-inclined members to provide support to Bin Laden on a covert basis in return for al-Qaeda's de facto agreement to leave the Arabian Peninsula in peace. As a WikiLeaks cable revealed, US Secretary of State Hillary Clinton wrote in a secret December 2009 memo, "More needs to be done since Saudi Arabia remains a critical financial support base for al-Qaeda, the Taliban, LeT [Lashkar-e-Toiba] and other terrorist groups."
With the destabilization of Yemen, that sort of modus vivendi became obsolete. As the terse diplomatic announcements of Defense Secretary Robert Gates' April 6 conversation with King Abdullah made clear, the Saudis were deeply concerned about the destabilization of Yemen by al-Qaeda along with Iran.

If Your Allies are People Who Are Bigots
And you engage in neocolonialism masquerading as protecting dark people, in this case, the citizens of Libya, your allies will not support you, because bigots are stupid, so unless you say, "We are bombing Libya to give their oil to our energy conglomerates," explicitly, they will not support you.
Case in point, Silvio Berlusconi and his racist buddies in the Northern League:
The phrase, "Hoist with his own petard," comes to mind.
Case in point, Silvio Berlusconi and his racist buddies in the Northern League:
Italy's belated decision to join the military campaign against Libyan dictator Muammar Gaddafi has brought fresh political woes for Prime Minister Silvio Berlusconi, with opposition to the bombing threatening to sink his fragile coalition.Considering his road to power, I find that is one of the most schadenfreude rich stories I've heard in a while.
Senior figures in the Northern League want an end to Italian air strikes only a week after they began following a personal plea by US President Barack Obama to Mr Berlusconi. Parliament will vote on the Northern League motion to this effect later today.
The xenophobic coalition partner says the bombing will provoke a wave of illegal immigration from Libya to Italy's southern coast, and is demanding Mr Berlusconi set a date to end the raids. Umberto Bossi, the pugnacious Northern League leader, had threatened to bring down the government if parliament was not allowed to vote on the issue. Interior Minister Roberto Maroni, another Northern League figure, predicted the government would fall if the bombing was not stopped.
The phrase, "Hoist with his own petard," comes to mind.

And While They Were Going After bin Laden, They Found Time to Kiss Up To The Banks…
The New York Times has an editorial excoriating the Obama administration for deregulating foreign currency swaps:
There can be a fine line between regulatory capture and corruption, and I am not sure on which side this falls.
In a way, this is worse than Bush and His Evil Minions™, because W was (correctly) perceived as a radical, but the actions of "Team Geithner" now firmly entrenched this thinking on both sides of the aisle.
H/t Paul Krugman for the graph pr0n.
A loophole in the law — which the bankers and their friends, including the administration, fought for — allows the Treasury secretary to exempt the instruments. The arguments in favor of exemption, beyond a desire to please the banks, were always unconvincing. They still are. The Treasury Department has asserted that the exempted market is not as risky as other derivatives markets, and therefore does not need full regulation.(emphasis mine)
That claim has been disputed by research, but even if it were true, it would be a weak argument. For instruments to be relatively safer than the derivatives that blew up in the crisis, necessitating huge bailouts, hardly makes them safe. Worse, dealers could probably find ways to manipulate the exempted transactions so as to hedge and speculate in ways that the law is intended to regulate.
……
The department has also said that because the market works well today, new rules could actually increase instability. That is perhaps the worst argument of all. It validates the antiregulatory ethos that led to the crisis and still threatens to block reform.
The Treasury’s plan will be open for comment for 30 days. Count us opposed.

You Know That if There is News, Republicans Will Lie About It
They are now claiming that torture got us Osama bin Laden, but it's a lie.

From these dates we can conclude that either KSM shielded the courier’s identity entirely until close to 2007, or he told his interrogators that there was a courier who might be protecting bin Laden early in his detention but they were never able to force him to give the courier’s true name or his location, at least not until three or four years after the waterboarding of KSM ended. That’s either a sign of the rank incompetence of KSM’s interrogators (that is, that they missed the significance of a courier protecting OBL), or a sign he was able to withstand whatever treatment they used with him.Expect more lies from Republicans on this, because this is what they do.
With al-Libi, the connection between whatever torture he experienced and this intelligence is less clear (since he was first detained in 2005), but even with al-Libi, it appears clear he either never revealed the courier’s real name or only did so after he had been in custody for a year, and almost certainly until after he arrived in Gitmo.
Update: Putting the AP’s reporting here together with the DAB, it seems like al-Libi did give up the name, perhaps earlier than reported. But still not waterboarding.

Ha Ha!
It seems to contain files from the Chamber, the American Legal Exchange Council, and the the Mackinac Center.
The last two are right wing front groups.
The ALEC writes legislation to kill unions as well as the poor and the elderly, and the Mackinac Center is yet another of those right wing so-called "think" tanks.
There is a caveat here, one which has been posted at AnonNews:
On April 29th a person using the twitter account “@septscelles” released a large file to Barrett Brown that purportedly contained secret US Chamber of Commerce documents. This file was later made available via File Dropper as a (strangely truecypted) torrent named "chambersecrets2". It is also reported to have been made available in an unencrypted form on the Pirate Bay.So obviously, breaking out the champagne is premature, though perhaps chilling it might not be a bad idea.
Despite the promise of secrets and leaks, early research has thus far shown that this information is publicly available through a simple Google search. It's very possible that “@septscelles” is just an attention seeking troll. Despite this, there is a more insidious possibility. We learned from the HB Gary emails that the Chamber of Commerce was advised to “feed the fuel between the feuding groups, [creating] disinformation." Specific mention was made of "[creating] messages around actions to sabotage or discredit the opposing organization [and to] submit fake documents and then call out the error…”
The file is very large, and will therefore take some time to fully examine. Nevertheless, we would like to state that this information was provided by an unknown party and may be an attempt to discredit Anonymous through a campaign of misinformation. More information will be coming soon.
You can go through the documents by downloading this torrent.

If You Want a Good Primer on the F-35's Electrical Power Systems…
And the problems therein, go read Bill Sweetman's latest on the latest problem with the Joint Strike Fighter (JSF).
Basically, it comes down to using bleeding edge technology, which, when juxtaposed with frantic weight reduction efforts, creates an absolute mess, just as it has with the failed bulkhead, the 360 degree vision system helmet and HUDless cockpit, etc.:
Too much whiz-bang for too much bucks.
Basically, it comes down to using bleeding edge technology, which, when juxtaposed with frantic weight reduction efforts, creates an absolute mess, just as it has with the failed bulkhead, the 360 degree vision system helmet and HUDless cockpit, etc.:
Another observation -- relevant to future programs -- is that the electrical problems (both this one and the AA-1 incident) have arisen from the use of a new system which, while it may have net advantages, is not core to the aircraft's capability -- you could in theory build a short-takeoff-and-landing stealth fighter without it.In the larger picture, this is actually the alpha and omega of weapons development.
The same goes for another headache area, the wide-field-of-view video helmet and HUD-less cockpit. The lesson may be that any innovations that fall into the nice-to-have rather than mission-essential capability should be low-risk when you incorporate them into the design.
Too much whiz-bang for too much bucks.

India Shortlists Rafale and Typhoon for MMRCA Shortlist
Well, I was wrong in my guess that MiG would win this.
But India has narrowed the bid to the French and the British:
These aircraft are clearly more capable in terms of payload and range than the Rafale (which is the light weight of the bunch) and the F-16, and faster than the F-18 (so is just about everything flying with an afterburner), and likely more reliable than the MiG.
My handicapping of the race? I think that Dassault is desperate for an export sale, and so will be willing to take a hit up front, and when this is juxtaposed with the fact that the IAF already has experience operating the Mirage 2000, I would give it a slight edge.
But India has narrowed the bid to the French and the British:
The United States lost a hard-fought competition to supply a new generation of fighter jets to India, which has listed two European manufacturers as the finalists for an order estimated to be worth $10 billion.I'm not sure what the calculus here.
The decision was a blow for President Obama, who had pushed hard for this and other defense deals during his visit to India in November as part of his agenda to deepen and broaden the United States’ relationship with India. The American ambassador to India, Timothy J. Roemer, who separately announced on Thursday that he would resign from his post for personal reasons, said the United States was “deeply disappointed by this news.”
While political and economic relations between India and the United States have been warming for years, American arms makers have struggled to win big contracts here. After decades of frosty relations during the cold war, which pushed India to rely extensively on the Soviet Union for military hardware, many in the Indian defense establishment are still wary of American intentions and United States military aid to Pakistan, India’s main adversary.
The American bid to build the fighters came from Boeing and Lockheed Martin. Boeing had offered its F/A -18 jets, and Lockheed Martin pitched its F-16 planes. But India instead narrowed the list to the Rafale fighter from Dassault and the Eurofighter Typhoon jet made by a consortium of European companies. Russian and Swedish bids were also turned down.
These aircraft are clearly more capable in terms of payload and range than the Rafale (which is the light weight of the bunch) and the F-16, and faster than the F-18 (so is just about everything flying with an afterburner), and likely more reliable than the MiG.

The Roberts Court Whores for Corporate America Again
They just ruled that companies can use arbitration clauses to require that each claim be settled individually, making it impossible for companies to be meaningfully punished for cheating large numbers of customers a few bucks at a time.
Unsurprisingly, it was AT&T that was cheating its customers, to the tune of $30 a pop, that was the defendant in this case.
I'm with Breyer on this:

I'm with Breyer on this:
But the dissenters said a practical ban on class action would be unfair to cheated consumers. Justice Stephen G. Breyer said the California courts had insisted on permitting class-action claims, despite arbitration clauses that forbade them. Otherwise, he said, it would allow a company to "insulate" itself "from liability for its own frauds by deliberately cheating large numbers of consumers out of individually small sums of money."But I would have been more frank. I would have said that the Scalia, et al, were creating a license to steal.

Economics Update
It's Jobless Thursday, and initial claim hit a 3 month high, 429 K, with the 4-week moving average rising, though continuing and extended claims fell.
The numbers have been disappointing, which is not surprising, since the economy grew at an anemic 1.8% annual rate in the 1st quarter.
The problem is that too many people in power (see Geithner, Timothy, for one) think that the economy is recovering fine because the banksters are making lots of money, so they are concerned about the deficit and inflation, as evidenced by this story with its hand wringing about inflation rising, but even though it's still well under the 2% (I would argue for 6% right now) that the Fed says that we need.
BTW, if you want to read it, here is the Federal Reserve Open Market Committee statement for you to read.

Why Not Gus Frerotte?
The most wanktastic representative in the Democratic caucus, Heath Shuler, had got himself a primary challenger, Cecil Bothwell:

North Carolina Blue Dog Democrat Heath Shuler is getting a primary challenge. He's not on Act Blue yet, but when he is, I will add him to my Act Blue page.
Councilman Cecil Bothwell, who originally said he would run as an independent, has changed his mind on the advice of friends and supporters, according to The Asheville Citizen-Times.
"I originally believed that the best way to address issues too long ignored and to challenge the corporate power over the national parties was to run as an independent," he said. "But I've heard from hundreds of people, from WNC to Washington, DC, who believe the most likely path to success is up the middle instead of trying for an end-run.”

Who Lent Harry Reid a Pair of Testicles?
Because he has just announced that he will be forcing a vote on the Senate floor on the Paul Ryan budget, which dismantles Medicare:
BTW, the Senate rules does not allow a filibuster of the budget.
Senate Majority Leader Harry Reid said it’s definite: He will scheduled a vote on House Republicans’ fiscal 2012 budget plan, which passed the House on a party-line vote earlier this month and includes the proposal to make Medicare a voucher-style health-care program for seniors. An "awkward situation", yes, I guess it is.
The move could create an awkward situation for some Senate Republicans, who would anger conservative constituents by voting no, but could alienate independents by voting yes. Sen. Susan Collins, a centrist Republican from Maine, said last week she’ll oppose the budget.
Senate Republicans “seem to be in love with the [Rep. Paul] Ryan budget, they’re going to get an opportunity to vote on the Ryan budget,” Mr. Reid said. Asked if he thought the Senate would defeat the House GOP budgetary plan, Mr. Reid said “I hope so.”

Vermont Senate Passes Single Payer Healthcare
The Vermont state Senate has now passed the single payer healthcare bill, and, assuming no problems in conference committee, will shortly head to the governor's desk, where he has promised to sign it.
Of course, the whole thing is dependent on getting a waiver from HHS, and I'm dubious of that bit, because Obama has shown himself to be the FIRE (Finance, Insurance, and Real Estate) sector's bitch, and you can be sure that the insurance companies will be trying to do whatever they can to drive a stake through the bill's heart.

Pass the Popcorn, Wikileaks Again
Wikileaks has now released about 700 documents on what is going on in the Guantánamo Bay gulag, and the picture is one of a completely incompetent and immoral process.
Cases in point:
It is refreshing to see the editorial page of the "paper of record" excoriate our gulag in the Caribbean, but unfortunately, they don't go further, and ask why there have been no prosecutions of the lawless incompetent torturers.
Cases in point:
- Wearing a cheap Casio watch was considered conclusive evidence that the wearer was a terrorist.
- 255 Inmates were "incriminated" on the basis of the testimony of just 8 inmates, basically whatever they could get out of jailhouse snitches and torture victims.
- Doctors actively concealed signed of torture.
The internal documents from the prison in Guantánamo Bay, Cuba, published in The Times on Monday were a chilling reminder of the legal and moral disaster that President George W. Bush created there. They describe the chaos, lawlessness and incompetence in his administration’s system for deciding detainees’ guilt or innocence and assessing whether they would be a threat if released.(emphasis mine)
It is refreshing to see the editorial page of the "paper of record" excoriate our gulag in the Caribbean, but unfortunately, they don't go further, and ask why there have been no prosecutions of the lawless incompetent torturers.

Well, Now We Know Why He Quit
It turns out that John Ensign made his resignation effective the day before he was to testify under oath before the Ethics Committee:
Senator John Ensign's resignation letter allows him to leave office just one day before he was to have to answer questions under oath about whether a $96,000 payment to the family of his former lover was illegal and designed to keep the affair from becoming public, according to people familiar with an investigation of Mr. Ensign's activities. To paraphrase King Kong, it was cowardice and hypocrisy that killed the beast.
That formal testimony, scheduled for May 4, was the final step as Senate investigators prepared for what were almost certain to be Senate ethics charges against Mr. Ensign, Republican of Nevada. Mr. Ensign's resignation is effective May 3.

And In the World of the Surreal…
I dunno, I find this kind of …… odd.A press release from the CIA explains that their "burn after reading" practice conserves energy because the exhaust from their incinerator generates steam to heat water at CIA headquarters. Says the CIA:In addition to saving fuel, that process reduces the amount of waste--which would otherwise be destined for landfills--by nearly 1,000 tons per year. The CIA increases its recycling efforts each year, annually collecting over three tons of plastic, glass, cardboard, aluminum, construction debris, and other waste.

About Bloody Time.
A US Federal Appeals Court has overturned the dismissal of manslaughter charges against the Blackwater (now Xe) mercenaries who massacred 14 Iraqis in 2007:
The lower court judge basically issued a blanked ruling saying that if Merc A said something that implicated Merc B, it was tainted, and the appellate court said no.
Hopefully this leads some of these guys to rat out on their associates.
You can read a good analysis here.
The U.S. won a bid to revive its manslaughter and weapons case against four former Blackwater Worldwide security guards accused in the 2007 deaths of 14 Iraqi civilians at a Baghdad intersection.Basically, the State Department promised immunity to each of the guards for their statements, and this is what led the dismissal, and the appellate court said that the immunity of each mercenary's statements applied only to prevented their use against that specific person, and not all of them, so the lower court had to refer to each indictment, and see whether the their own statements were used against them.
The U.S. Court of Appeals in Washington today reversed the decision of a lower-court judge, who dismissed the charges because statements the men made to State Department investigators may have influenced the grand jury.
“In sifting the record as to taint of the evidence before the indicting grand jury, the district court made a number of systemic errors based on an erroneous legal analysis,” said the appeals court.

Because Running the Government By, and For, the Banksters is Depressing
It's why Americans are more pessimistic about the economy and their future than they have been in years:
Truth be told, when thegood least bad guys Washington, DC think that everything is fine because banksters are doing better, even though unemployment is almost 9% (over 15% for the more accurate U-6), the American public is in the right frame of mind, we are unbelievably screwed.
Americans are more pessimistic about the nation’s economic outlook and overall direction than they have been at any time since President Obama’s first two months in office, when the country was still officially ensnared in the Great Recession, according to the latest New York Times/CBS News poll. The Republicans must be high fiving each other in private about this, a bad economy presages a Republican takeover of the Senate, and possibly the White House.
Amid rising gas prices, stubborn unemployment and a cacophonous debate in Washington over the federal government’s ability to meet its future obligations, the poll presents stark evidence that the slow, if unsteady, gains in public confidence earlier this year that a recovery was under way are now all but gone.
Capturing what appears to be an abrupt change in attitude, the survey shows that the number of Americans who think the economy is getting worse has jumped 13 percentage points in just one month. Though there have been encouraging signs of renewed growth since last fall, many economists are having second thoughts, warning that the pace of expansion might not be fast enough to create significant numbers of new jobs.
The dour public mood is dragging down ratings for both parties in Congress and for President Obama, the poll found.
Truth be told, when the

Koch Whores
Koch Industries is now explicitly coercing its workers about who they vote for:
Truly repugnant.
On the eve of the November midterm elections, Koch Industries sent an urgent letter to most of its 50,000 employees advising them on whom to vote for and warning them about the dire consequences to their families, their jobs and their country should they choose to vote otherwise. This is what happens when people who earned their fortune through the genetic lottery think that they own the people who work for them.
The Nation obtained the Koch Industries election packet for Washington State [1]—which included a cover letter from its president and COO, David Robertson; a list of Koch-endorsed state and federal candidates; and an issue of the company newsletter, Discovery, full of alarmist right-wing propaganda.
Legal experts interviewed for this story called the blatant corporate politicking highly unusual, although no longer skirting the edge of legality, thanks to last year’s Citizens United Supreme Court decision, which granted free speech rights to corporations.
“Before Citizens United, federal election law allowed a company like Koch Industries to talk to officers and shareholders about whom to vote for, but not to talk with employees about whom to vote for,” explains Paul M. Secunda, associate professor of law at Marquette University. But according to Secunda, who recently wrote in The Yale Law Journal Online about the effects of Citizens United on political coercion in the workplace, the decision knocked down those regulations. “Now, companies like Koch Industries are free to send out newsletters persuading their employees how to vote. They can even intimidate their employees into voting for their candidates.” Secunda adds, “It’s a very troubling situation.”
Truly repugnant.

Do you want to guess?
Is it in Missippi, or Alabama, or maybe Arkansas?
Nope, it's in New York State, just an hour from Times Square. It's Kiryas Joel, which has a mind boggling 70% poverty rate: (number 2 only has a 56% rate)
Kiryas Joel is a hole in the map created by cynical New York politicians in order to pander, and since then it has been used to suck up various welfare payments, so that able bodied residents could game local government for handouts.
Judaism is very clear about this: Studying is good, but there is also an obligation to work and support a family.

The poorest place in the United States is not a dusty Texas border town, a hollow in Appalachia, a remote Indian reservation or a blighted urban neighborhood. It has no slums or homeless people. No one who lives there is shabbily dressed or has to go hungry. Crime is virtually nonexistent.Normally, I am not inclined to tell people that they need to get off their asses, and get a real job, but in this case, I'm going to say get off your asses and get a job.
And, yet, officially, at least, none of the nation’s 3,700 villages, towns or cities with more than 10,000 people has a higher proportion of its population living in poverty than Kiryas Joel, N.Y., a community of mostly garden apartments and town houses 50 miles northwest of New York City in suburban Orange County.
About 70 percent of the village’s 21,000 residents live in households whose income falls below the federal poverty threshold, according to the Census Bureau. Median family income ($17,929) and per capita income ($4,494) rank lower than any other comparable place in the country. Nearly half of the village’s households reported less than $15,000 in annual income.
About half of the residents receive food stamps, and one-third receive Medicaid benefits and rely on federal vouchers to help pay their housing costs.
Kiryas Joel’s unlikely ranking results largely from religious and cultural factors. Ultra-Orthodox Satmar Hasidic Jews predominate in the village; many of them moved there from Williamsburg, Brooklyn, beginning in the 1970s to accommodate a population that was growing geometrically.
Kiryas Joel is a hole in the map created by cynical New York politicians in order to pander, and since then it has been used to suck up various welfare payments, so that able bodied residents could game local government for handouts.
Judaism is very clear about this: Studying is good, but there is also an obligation to work and support a family.

John Ensign Resigning Senate Seat
John Ensign has announced that he will be resigning from the US Senate in May:
I'm going to call my Senators, and ask them to continue the investigation even though he is leaving, he shouldn't skate, and given that the DoJ under Eric "Place" Holder has dropped their investigation of him.
Embattled Sen. John Ensign announced this afternoon he will resign from office, effective May 3. The move opens the door for Republican Gov. Brian Sandoval to appoint Rep. Dean Heller to finish out the term.Ralston was on Maddow just now and said that the Ethics Committee had just held a secret vote to open a public investigation of his activities, basically f%$#ing his best friend's wife (both staffers) and paying them off, and this is what precipitated his exit.
"It is with tremendous sadness that I officially hand over the Senate seat that I have held for eleven years," Ensign said in a statement. "The turbulence of these last few years is greatly surpassed by the incredible privilege that I feel to have been entrusted to serve the people of Nevada. I can honestly say that being a United States Senator has been the honor of my life."
Sun columnist Jon Ralston first reported earlier in the afternoon that Ensign would step down.

The National Labor Relations Board has Boeing locating the 2nd assembly line for the 787 in South Carolina was part of illegal union busting activity:
First, they were big enough assholes that they got engineers to go out on strike and stay on strike, then they f%$#ed up the bidding on the next gen tanker twice (the first time was when they bribed an official to cut them an unconscionable lease deal), and now they have been so arrogant to get the normally hapless NLRB to unload a can of whup ass on then.

Boeing illegally put its second 787 Dreamliner assembly line in South Carolina in retaliation for strikes in Washington and should be required to build the line in Washington, according to a potentially groundbreaking National Labor Relations Board complaint (pdf) filed Wednesday.Seriously, since Boeing bought McDonnell Douglas, and the failed McDonnell Douglas management team ended up running the company, they have consistently failed in ways that stun me.
NLRB Acting General Counsel Lafe Solomon filed the complaint after investigating a charge that the International Association of Machinists and Aerospace Workers union District 751, bargaining unit, backed by the national union, filed on March 29, 2010. A board administrative law judge is scheduled to hear the case on June 14.

Wisconsin Election(s) Update
In the Wisconsin Supreme Court race, JoAnne Kloppenburg filed a petition with the Government Accountability Board for a recount, which is automatic, and at state expense, because the margin was less than the ½% margin.
She also called for an investigation of the actions of Waukesha County Clerk Kathy Nickolaus, who has been using odd methods, and generating odd results, for years.
I don't know how this will turn out, but given that Wisconsin uses paper ballots, my guess is that Ms. Nickolaus will not look good at the end of this, because even if she isn't shown to have engaged in ballot fraud, her history of incompetence is well documented.
Additionally, it looks like Wisconsin will be more than doubling its recall elections in its history, there have been 4 total in history, but now 5 recall petitions have already been filed against state senators, which means that there should be at least 5 recall elections.
I would expect a lot of money from the Koch brothers to flow in for both the recount and the elections.

And the Escalation into an Attempt at Regime Change Continues
Both the French and the British intend to send troops in to, "Protect aid deliveries," despite the fact that Valerie Amos, the Under-Secretary-General for Humanitarian Affairs and Emergency Relief, has said that this is not necessary, and may risk conflating the aid program with military action.
The problem here is that there have been explicit calls for regime change since the UN resolution had passed, and because the Qaddafi regime has refused to collapse like a bunch of wet broccoli, the French and the British have felt the need to escalate in order to save face.
Not like Vietnam at all.
Sarkosy is trying to save his ass in the next elections, and Cameron is trying to distract the British public from the failure of his full throated embrace of Hoovernomics, and they thought that a "Private Little War" would be good for politics, and it allowed them to get their colonialist rocks off as a bonus.
Unfortunately, wars are never a certainty.

Bradley Manning Has Been Transfered from Quantico to Leavenworth
And it appears that the conditions of his confinement will improve significantly:
Between members of the British Parliament demanding an accounting of his treatment, Manning holds dual UK-US citizenship, and the UN Special Investigator demanding access, I think that the attempt by the Obama administration to extort a false accusation from Bradley Manning against Julian Assange has finally become politically untenable.
Props to those people who made this politically untenable.
The family of Bradley Manning has welcomed news that he has been moved from a top security military prison in Quantico, Virginia, to a "more open" military facility in Kansas. This did not happen because either the Pentagon or the Obama administration wanted this.
Manning, the US soldier accused of downloading and leaking classified cables to WikiLeaks, was transferred to Fort Leavenworth, Kansas, early on Wednesday, his aunt, Sharon Staples, confirmed.
His transfer follows sustained protests from human rights campaigners and others over his conditions at Quantico, where he was held in solitary confinement and on suicide watch, which has required him to be stripped naked at night apart from a smock and checked on repeatedly.
The commander of the Kansas facility said Manning would now receive three hours of recreation a day, and would "have the capability to interact with other pre-trial inmates on a routine basis". Psychiatrists would assess his mental, physical, emotional and spiritual health on arrival, Lt Col Dawn Hilton said.
